Abstract

The research question addressed is how the litigation of disciplinary issues (corporal punishment, searches and seizures, and suspensions) has influenced secondary school administrators' efforts to maintain a safe school environment. Motivating key influences for this study were the author's background as an attorney and as a practicing teacher, in addition to the case law regarding disciplinary issues. The research study consisted of a ten question anonymous survey through a survey website directed at a random sampling of secondary school administrators in Hennepin and Dakota Counties in Minnesota and Shelby County in Tennessee. The results of the survey indicated that litigation of disciplinary issues has altered school policy and procedures, however administrators have adapted to the changes successfully. While there are more legal restrictions on administrators' powers, their responses to the survey indicated that they have struck an appropriate balance between maintaining a safe school environment and protecting students' rights.
